These following Terms and Conditions apply to visitors and clients of this website and any website(s) owned and operated by Games Media Inc. and are binding individually or as a whole. In case of a breach of any terms herein Games Media Inc. reserves the right to cancel or terminate any service provided to its clients or suspend a client's user account with or without prior notice.

Games Media Inc. reserves the right to bring modifications to these terms and conditions at any time without prior notice. We recommend that clients and visitors consult this document often to ensure compliance and to remain informed about its implications. Games Media Inc. will however attempt to use best business practices to advise its clients and visitors on these modifications by means of emails, newsletters, press releases or news postings. Games Media Inc. cannot be liable for any misinterpretation, loss of business or damage of any kind, directly or indirectly related to using our services. By viewing our website(s) and/or using our services you discharge Games Media Inc. from any claims of damage or disruption of any business for you or any third party. By viewing our website(s), inquiring information or using our services you also agree to these Terms and Conditions herein.

All content on this website and any website(s) owned and operated by Games Media Inc. are protected by copyright laws. Reproduction or distribution of any kind is strictly prohibited without prior written permission from its owners, including but not limited to text, images and logos.

Games Media Inc. cannot be held responsible for any of the views, opinions, or communications of any kind expressed by its clients or users of their website(s) or service(s), through such means as general message boards, private messaging, emails or any other communication methods, whether it is between users, moderators or any person, or directed to the mass public.

2) Privacy Policy
Games Media Inc. strongly believes in the privacy of your personal information and thus will never share it with any third party. The information we collect on our clients is only used for internal use and for standard business practices. We may collect such information as emails, phone numbers and addresses to better service our existing clients or to help determine best possible solutions for prospecting visitors. Usually this information is given to us voluntarily through a contact form or a newsletter subscription, thus never forcing or tricking our clients or visitors.

3) Acceptable Use Policy
By using the various services provided by Games Media Inc. you ensure to comply with the following Acceptable Use Policy. This policy is binding to any and all of our services now or hereafter provided, including but not limited to video games, live chat, hosting, website design, content management, and e-commerce solutions. If any customer does not agree to be bound to this acceptable use policy they must immediately cease to use our services and contact us to thus prevent any possible penalty or loss of business.

The following activities or business practices represent a violation of our acceptable uses:

  • Any activity related to hate crimes such as but not limited to prejudice, racism, intolerance, hatred, and harassment.
  • Any activity related to the violation of copyrights and intellectual property rights of others.
  • Any activity related to pyramid schemes, fraudulent or illegal soliciting schemes.
  • Any spamming activities and misleading or unlawful business practices.
  • Any activities related to hacking, pirating, or the spread of viruses of any kind.
  • Any activities related to server abuse such as but not limited to IRC, Proxies, PHP Shell, "Mailbombing", "Crashing" any system, bots or illegal softwares.

4) Refund Policy
Games Media Inc. has a no-refund policy. It is the responsibility of the client to properly inform themselves prior to using, purchasing or subscribing to any of our services. In some situations, such as; during beta-testing or prolonged technical issues, and determined on a case per case basis, Games Media Inc. could review and accord a partial refund.

5) Credits
For certain websites and services, such as the multiplayer game Sift Heads™ Street Wars found on www.siftheads.net, users may purchase credits to use in the game. These credits are used not only to buy items within the game, but may be used also to unlock missions, game plays, access new areas of the game or to gain certain user privileges. Games Media Inc. cannot be held responsible for the way users of their websites or services use their credits and what they decide to buy. Credit values and credit prices are defined within the website or service and may be updated without prior notice, such as but not limited to beta-testing and periodical promotions.

6) Service Guarantee
Games Media Inc. cannot make claim to any guarantee whatsoever for any of our services, whether for hosting \"uptime\" or customer satisfaction of any kind. Games Media Inc. will use its reasonable efforts to provide services 24 hours a day, seven days a week. Subscriber acknowledges that from time to time the services may be inaccessible or inoperable for many reasons, including scheduled downtime due to maintenance or upgrades; or server malfunctions, and reasons beyond Games Media Inc.'s control, including the interruption or failure of communication connections, hack attacks, or network congestion. Games Media Inc. will attempt to provide notice to our customers and visitors when possible about scheduled downtimes and will use the best possible means to minimize any disruption, inaccessibility or inoperability of its servers. Games Media Inc. has no responsibility for downtime resulting from a user's actions or server attacks. The subscriber agrees to indemnify and hold harmless Games Media Inc. from any claims resulting from the customer's use of our services which damages the customer or any other party. It is the client's responsibility to evaluate the risk of using such services.

7) Cancellation Procedures
To cancel a service with Games Media Inc. we ask that you make an official cancellation request or follow the procedures available on our site(s). If possible cancellation will be instant or will be made during your next billing period. Any sales promotion or rebate will not be refunded. Any violation of our Terms and Conditions shall result in no refund. Once the service is cancelled, we will terminate the client's account and all information, files, emails within the account will be deleted from our servers.
